Introduced in 2013, the NSW Child Window Safety Legislation made it mandatory for Owners’ Corporations to install child window safety devices to all high-risk windows in their property or risk personal liability.

It is important that owners’ corporations know their ongoing compliance responsibilities around child window safety, and continue to meet legislative requirements through regular inspections, maintenance and testing of window safety devices.

ASQB’s compliance audit services ensures child window safety devices are regularly inspected and tested against relevant legislation to safeguard their effectiveness. This will enable any faulty devices to be identified, and rectified, whilst also maintaining a detailed and up-to-date compliance record for your property, thereby minimising any risk.

Ongoing Safety Compliance Audits

Over time, window safety devices can fail to work effectively, resulting in your windows becoming non-compliant.

Common reasons window safety devices fail to comply:

  • Device misuse resulting in damage to the device or window
  • Device removal leaving the window completely exposed.
  • General damage
  • Lost keys meaning a device can no longer be locked into the safe position

ASQB recommends having window safety devices audited annually, at a minimum

What a Window Safety Compliance Audit Involves

The inspection and assessment of every child window safety device throughout a residence

Each window safety device will be checked in accordance with legislative requirements.

If required, on the spot maintenance or replacement of non-compliant child window safety devices will be performed.

A new compliance certificate will be issued for each residence visited.

How do I know if my current child window safety devices meet legislative requirements?

A window safety device that meets legal requirements must answer yes to the following questions:

WINDOW SAFETY DEVICE

  1. Are the keys present?
  2. Can the window be locked in the closed position
  3. Can the window be locked in a vent position less than 12.5cm?
  4. When the lock is engaged, can it resist a force greater than 25kg?


GENERAL WINDOW CONDITION
: The condition of both the frame and sash should also be considered when assessing the window safety device. If the window does not operate as intended, it should undergo a service to ensure occupants’ safety.

WINDOW SECURITY SCREEN (including bars & safety grills)

  1. Are all gaps less than 12.5cm?
  2. Can the screen resist an outward pressure of 25kg?


GENERAL WINDOW CONDITION :
The condition of both the frame and sash should also be considered when assessing any screens or grills that are attached to them. If the window does not operate as intended, it should undergo a service to ensure occupants’ safety.

When does a window require a child window safety device?

If the window sill is less than 1.7m above the internal floor, and that floor is 2m or more above the external surface outside, a window safety device must be installed.
